3.2. Paid Plans: Vidlyst AI offers various subscription plans (e.g., Starter, Pro, Enterprise). You agree to pay all fees associated with your chosen plan in accordance with the billing terms in effect at the time a fee or charge is due and payable.
3.3. Payment Processing: We use third-party payment processors (e.g., Stripe) to handle secure payments. We do not store your full credit card information.
3.4. Cancellation: You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. We generally do not offer refunds for partial billing periods, except as required by applicable law.
4.1. Your Ownership: You retain all rights and ownership of your User Content. We do not claim any ownership rights over your uploads.
4.2. License to Vidlyst AI: By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, process, and display your User Content solely for the purpose of providing and improving the Service (e.g., generating your video).
4.3. Ownership of Output: You own all rights, title, and interest in and to the Output generated by the Service for you, subject to your compliance with these Terms.
4.4. Vidlyst AI IP: The Service itself, including its software, algorithms, design, and branding, remains the exclusive property of Vidlyst AI and its licensors.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIDLYST AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Vidlyst AI and its officers, directors, and employees from any claims, damages, liabilities, and expenses arising out of your use of the Service or violation of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the Service or by email. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
